This checklist offers a framework for developing a briefing for a newly appointed Adjutant General. Even when the Adjutant General brings prior staff or operational experience, reviewing this information can still be valuable.
Review the legal authorities governing the use of the National Guard in State Active Duty (SAD):
Identify law enforcement or peace officer authorities granted to the National Guard under state law.
Understand state law governing citizen’s arrests and any other traditional police powers that are granted to civilians.
Engage your staff judge advocate to look into the issue of civil liability for actions of your National Guard troops.
Review the legal authorities governing the use of the National Guard under Title 32 (T32).
Review the legal and doctrinal authorities governing the use of the National Guard under Title 10 (T10).
Review the chain of command for SAD, T32, and T10.
